Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the Speedforge website at speedforge.ai, our waitlist, our developer tools (SF Hopper, SF Dynamo, SF Threads, SF Braids, SF Focus), our APIs, our desktop applications, and any other services we offer (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
If you are using the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
Who Speedforge Is For
Speedforge builds developer productivity tools, with a particular focus on engineers who run multi-agent and multi-window workflows. The Service is intended for software professionals, technical operators, and the organizations that employ them.
- You must be at least 18 years old to use the Service.
- You must have the legal capacity to enter into a binding contract.
- You may not use the Service if you are barred from doing so under applicable law.
Beta and Pre-Release Software
Several Speedforge products are currently in early access, private beta, or active development. You acknowledge and agree that:
- Pre-release products may contain bugs, errors, or incomplete features.
- We may add, change, deprecate, or remove features at any time without notice.
- We may impose usage limits, throttle workloads, or temporarily disable features for stability or safety reasons.
- Beta and waitlist access is offered at our discretion and may be revoked.
- Pricing, packaging, and product availability published on the website are forward-looking and may change before general availability.
Accounts, Waitlist, and Access
- Joining the waitlist does not guarantee access to any product.
- You are responsible for maintaining the confidentiality of any credentials, API keys, or access tokens issued to you.
- You must provide accurate, complete information when signing up and keep that information current.
- You are responsible for all activity that occurs under your account.
- You must notify us promptly at security@speedforge.ai if you suspect unauthorized access.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Reverse engineer, decompile, or attempt to extract source code from the Service, except to the extent permitted by applicable law.
- Resell, sublicense, or white-label the Service without a written commercial agreement with us.
- Use the Service to build a competing product or to benchmark it for the purpose of building a competing product.
- Attempt to gain unauthorized access to any portion of the Service, other accounts, or our infrastructure.
- Probe, scan, or test the vulnerability of the Service except under a written security-research agreement.
- Interfere with or disrupt the Service, including by introducing malware, exhausting resources, or evading rate limits.
- Use the Service to generate or distribute content that is illegal, harassing, defamatory, or that infringes the rights of others.
- Use the Service to train models that compete with Speedforge.
Your Content and Inputs
You retain all rights to the code, prompts, transcripts, project files, and other content you submit to the Service (“Inputs”) and to any outputs generated from those Inputs (“Outputs”). You grant Speedforge a worldwide, non-exclusive, royalty-free license to host, process, and transmit your Inputs and Outputs solely to the extent necessary to operate, secure, and improve the Service for you.
We do not use your private Inputs or Outputs to train models that benefit other customers without your explicit consent. Aggregated, de-identified telemetry may be used to operate and improve the Service.
Third-Party Services and Models
The Service integrates with third-party tools and AI model providers (which may include Anthropic, OpenAI, Google, ElevenLabs, Linear, Fly.io, Supabase, Vercel, and Cloudflare, among others). Your use of those third parties is governed by their own terms. We are not responsible for the availability, accuracy, or behavior of any third-party service, and the routing of requests to a specific model or provider may change.
Speedforge IP
The Speedforge name, logos, product names (including SF Hopper, SF Dynamo, SF Threads, SF Braids, and SF Focus), website, source code, designs, documentation, and any associated trademarks are owned by Speedforge or its licensors and are protected by copyright, trademark, and other intellectual property laws. We reserve all rights not expressly granted to you in these Terms.
If you provide feedback, suggestions, or feature requests, you grant us a perpetual, irrevocable, royalty-free license to use that feedback to improve the Service without obligation to you.
Fees and Payment
- Subscription fees are billed in advance on the cycle you select (monthly or annual) and are non-refundable except where required by law.
- Usage-based fees, where applicable, are billed in arrears based on metered usage.
- You are responsible for any taxes other than those based on Speedforge’s net income.
- If a payment fails, we may suspend or downgrade your access until the balance is resolved.
- We may change pricing on a going-forward basis with at least 30 days’ notice via email or in-product notification.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if your use creates risk or possible legal exposure for us, or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including IP, disclaimers, limitations of liability, and dispute resolution) will survive.
Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES. YOU ARE RESPONSIBLE FOR REVIEWING AND VALIDATING ANY CODE, TESTS, OR ARTIFACTS PRODUCED BY THE SERVICE BEFORE USING THEM IN PRODUCTION.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SPEEDFORGE OR ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS, OR (B) THE FEES YOU PAID TO SPEEDFORGE FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to defend, indemnify, and hold Speedforge harmless from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Service in violation of these Terms, (b) your Inputs, or (c) your violation of any law or third-party right.
Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of these Terms or the Service is the state and federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the website prior to the changes taking effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of them.
